The Terms of Service have been comprehensively rewritten and restructured, effective November 15, 2023, replacing the April 8, 2019 version. The changes introduce new obligations for users and expand Webflow's rights.

• Effective date updated from April 8, 2019 to November 15, 2023; a "last modified" date now appears.
• Incorporated policies expanded: The new version explicitly incorporates the Acceptable Use Policy, Intellectual Property Policy, Trademark Usage Policy, Product Specific Terms, Data Processing Addendum, Beta Program Terms and Conditions, Community Terms, and others; the old version only referenced Global Privacy Policy, EU & Swiss Privacy Policy, and Template Submission Guidelines.
• Account ownership disputes: New section 2.6 describes factors Webflow may use to determine account ownership based on primary email, billing details, and its sole discretion.
• Primary Email Address: New section 2.3 makes you responsible for maintaining access to your primary email; Webflow disclaims liability if you lose access.
• HIPAA non-compliance: New section 3.6 states the platform is not HIPAA-compliant and you agree not to provide Protected Health Information.
• CSAM scanning: New section 3.7 permits Webflow to proactively scan Website Content for Child Sex Abuse Materials and report to law enforcement.
• Confidentiality: New section 11 imposes confidentiality obligations on both parties regarding non-public information, surviving for 5 years after termination.
• Liability cap increased from $1 to $100.
• Billing and refunds: Annual plans are now stated as "non-refundable" and a separate Billing and Refund Policy is referenced; cancellation method is now specified (dashboard downgrade).
• Privacy policy: References a single Privacy Policy instead of separate Global and EU/Swiss policies; the new version states the Privacy Policy is not a contract.
• Intellectual property policy: Replaced detailed DMCA procedure with a reference to an Intellectual Property Policy and Trademark Policy.
• US Economic Sanctions: New section 17 restricts use by embargoed countries and sanctioned parties.
• Assignment clause: Previously only you could not assign; now both parties need prior written consent, but Webflow may assign to an affiliate or in a merger.
• Indemnification: Expanded to cover losses from "Website Designers, your clients" and from Additional Product Offerings.
• Disclaimer of warranties now explicitly covers Marketplace and Marketplace Products.
• E-Commerce section removed as a standalone section; e-commerce obligations are now covered under Product Specific Terms.
